If you are not completely satisfied with your purchase, you may return the item within 15 days of receipt, provided the item is in its original condition and packaging. II. User Account Terms

F. Consequences of Violation: Violations of these User Account Terms may result in immediate termination of your account, and could also result in legal action being taken against you.

G. Account Disputes: In cases of disputes about account ownership, we reserve the right to request documentation to determine or confirm account ownership. We also reserve the right to determine, in our sole judgment, rightful account ownership and transfer an account to the rightful owner.

G. Purchases and Returns: Users must adhere to our 15-day return policy for purchases made from the TEE.LGBT shop. Details of this policy are provided separately.

H. Privacy: You must review our Privacy Policy which outlines our practices towards handling any personal data that you provide to us. By using our Services, you agree to the collection and use of your personal data as outlined in our Privacy Policy.

I. Use of Analytics: By using our Services, you agree to our use of Google Analytics and Facebook Pixel for tracking viewership and advertising performance.

IV. Service Provision

A. Description of Services: TEE.LGBT provides an online platform for the LGBTQIA+ community to connect, meet, and build relationships. The services offered include the TEE.LGBT Dating App and an online shop offering merchandise for the LGBTQIA+ community. The specific features and functionality of the services are subject to change and may not be available in all regions or to all users.

B. Modification of Services: Radergy S.R.L. reserves the right to modify or discontinue, temporarily or permanently, the Services with or without notice to the user. You agree that Radergy S.R.L. shall not be liable to you or any third party for any modification, suspension or discontinuance of the Services.

C. Availability of Services: While we strive to ensure our Services are available at all times, we do not guarantee, represent or warrant that access to our Services will be uninterrupted or error-free, and we do not guarantee that users will be able to access or use all the features at all times.

D. Third-Party Services: Our Services may be integrated with services provided by third parties as part of the functionality of the Dating App and Shop. You understand and agree that Radergy S.R.L. cannot control and is not responsible for the content, terms of use, privacy policies, or practices of such third-party services.

E. User Support: Radergy S.R.L. offers support for its Services to users. However, the speed and availability of support are subject to current demand and available resources.

F. Termination: Radergy S.R.L. reserves the right, without notice and in its sole discretion, to terminate your license to use the Services and to block or prevent your future access to and use of the Services.

G. Service Updates: Radergy S.R.L. may from time to time provide automatic or manual updates and upgrades to the Services to improve the performance and capabilities of the Services. These updates and upgrades are subject to these Terms of Service unless explicitly stated otherwise.

VIII. Disputes and Legal Jurisdiction

A. Governing Law: The Terms of Service, its interpretation, and any disputes that arise hereunder shall be governed in all respects by the laws of Romania, without regard to conflict of law provisions.

B. Dispute Resolution: Should any dispute arise between you and Radergy S.R.L. relating to the use of our services, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

C. Arbitration: In the event that we are unable to resolve a dispute, we both agree that any disputes shall be resolved solely through final and binding arbitration, rather than a court. The arbitration shall be conducted by a single, neutral arbitrator in the location that is most convenient for the consumer.

D. Court Jurisdiction: Notwithstanding the agreement to resolve all disputes through arbitration, either party may bring an action in court to protect its intellectual property rights (‘intellectual property rights’ means patents, copyrights, moral rights, trademarks, and trade secrets, but not privacy or publicity rights).

E. Class Action Waiver: Both you and Radergy S.R.L. agree that any proceedings to resolve or litigate any dispute whether through a court of law or arbitration shall be solely conducted on an individual basis. You agree that you will not seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action.

F. Legal Compliance: You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of our services.

G. Time Limitation: You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

IX. Limitation of Liability

A. General Limitation: To the fullest extent permitted by applicable law, Radergy S.R.L. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

B. Specific Limitations: Radergy S.R.L. will not be liable for any damage, loss or injury resulting from hacking, tampering, or other unauthorized access or use of the services or your account or the information contained therein. We will also not be responsible for any losses or damages incurred as a result of any errors in our services or inaccuracies in the content provided.

C. Consumer Protection: This section (and any other clause excluding or restricting our liability) applies to our directors, officers, employees, subcontractors, agents, and affiliated companies, as well as to Radergy S.R.L. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you.

D. Limitation Cap: In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid Radergy S.R.L. in the last six (6) months, or, if greater, one hundred dollars ($100). The limitations of damages set forth above are fundamental elements of the basis of the bargain between Radergy S.R.L. and you.

E. Application: These limitations of liability apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Radergy S.R.L. has been advised of the possibility of such damage.

X. Terms Termination

A. By User: Users may terminate their agreement with these Terms of Service at any time by discontinuing use of the services provided by Radergy S.R.L. and the TEE.LGBT shop and dating app.

B. By Radergy S.R.L.: Radergy S.R.L. reserves the right to suspend or terminate your access to the services and delete your account if it is determined that you have violated these Terms of Service, pose a risk to Radergy S.R.L., or for any other reason at the discretion of Radergy S.R.L.

C. Effect of Termination: Upon termination, all licenses and other rights granted to you in these Terms of Service will immediately cease. Radergy S.R.L. is not liable for any losses suffered by you due to any termination of these Terms of Service.

D. Survival of Terms: All sections of these Terms of Service which, by their nature should survive termination, will survive termination, including, without limitation, accrued rights to payment, use restrictions, warranty disclaimers, indemnity obligations, and limitations of liability.

E. Changes to Terms of Service: Radergy S.R.L. reserves the right to revise these Terms of Service at any time by updating this posting. It is your responsibility to regularly check this site to determine if there have been changes to these Terms of Service and to review such changes. Your continued use of the services after any such changes are made will constitute your agreement to such changes.

A. Revision of Terms: Radergy S.R.L. reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time. If the alterations constitute a material change, Radergy S.R.L. will notify users via an update on the TEE.LGBT website or through an email notification.

Radergy S.R.L. expressly disclaims any liability for negative consequences that may arise from the use of our products or services in jurisdictions where there is a known risk to the LGBTQIA+ community. Exercise caution and thoroughly research the legal and social climate of your area before making a purchase.
